I was notified that I was selected for DV-2007 in Apr 2006. I read the instructions carefully and saw that I could apply for AOS as I am already in the US (H1B). Per instruction, I made an appt thru Infopass and asked an officer if I was eligible for AOS. She said yes and to go ahead immediately, as there were processing my numbers right now.

I sent everything in within 2 weeks and received notification for Biometric almost immediately. Did the Biometric on May 20th and have been waiting for the next step. Today I received a letter saying my application for AOS was denied because the application period is only from Oct 2006 - Sep 2007 and I applied on May 1st 2006 which was the time period for the DV 2006 lottery winners. Note that the only reason I sent everything in so early was because the lady officer gave me the green light to do so. My questions, if anyone out there can help me...
1. Am I completely disqualified or can I wait until after Oct 1 2006 to apply again?
2. I already paid $395 ($325 apllication fee + $70 biometric) - do I lose that?

I am so distraught - here I am waiting for an interview date and I get this bad news instead!

Can anyone help me???
