A UK Work Permit is a document issued by the Work Permits (UK), a part of the Home Office Immigration and Nationality Directorate; it gives you permission to employ a specific person in a specific job at a specific location.

A UK Work Permit is not a permission for the employee to take up work in the UK. The permission for an employee to enter and work in the UK is conferred by a UK Immigration or Consular officer who, following the issue of a Work Permit, may issue to the employee a suitable visa. The visa is an endorsement stamped in the employee's passport.

Even if an employee is already working in the UK on a Work Permit, a new employer must obtain a new Work Permit before the employee can change jobs.

Default Old work permit status after getting new work permit

Hi,

I have a question about this work permit thing... is What happens to existing work permit (your present employer) if you get a new work permit (from your new employer)? Does your old WP gets cancelled as soon as your new WP is approved? If yes then how can one serve a notice period (let say 1 month) for the current employer because i believe its safe to resign only when you know your new work permit has been approved by home office?

Thanks & Regards

Work permits are issued for a specific person in a specific job for a specific employer. Work permits are not transferable between employers or between jobs within the same company.

If a person has a work permit and wishes to take additional work they may do so without further permission from the Home Office provided the work:

is outside of their normal working hours;
is no more than 20 hours per week;
is in the same profession and at the same professional level for which the holder's work permit was issued; and
is not employed by a recruitment agency, employment agency or similar business to provide personnel to a client.
The work permit holder is not allowed to enter self-employment, set-up a business or join another business as a director or partner. If a work permit holder wishes to be self-employed or set up a business he/she will need to apply to the Home Office for Leave to Remain for this purpose.

Multiple Entry Work Permit holders are not permitted to take supplementary employment.

Hope this helps.

Hi,

Thanks for your reply John. Actually my question was different. I will give an example...

My work permit (WP) is held by "CompanyA". I want to join "CompanyB". For this "CompanyB" will sponser my WP and if it gets approved then i can start working for them provided i have sufficient leave to remain in UK and then get my passport endorsed within 6 months.

Now my query is, if my WP through "CompanyB" gets approved, what happens to the WP from "CompanyA"? Will home office contact them and ask them to cancel it within some time OR does it gets cancelled automatically?

Once my WP through "CompanyB" is approved, i would like to give "CompanyA" 2 months notice that i will leave them after two months and so work with them for next two months and then join "CompanyB". Can i do this?

Also if my application through "CompanyB" is not successful then what will be the status of WP held by "CompanyA"?

Sorry for posting such a long question but i am trying to clarify this since a long time.

Thanks & Regards
Pawan
