Visa Waiver Program

The Visa Waiver Program permits nationals from designated countries to apply for admission to the U.S. for ninety days or less as nonimmigrant visitors for business or pleasure without first obtaining a nonimmigrant visa.


I. Benefits of the Visa Waiver Program

The advantage of entering the U.S. under the Visa Waiver Program is that tourists and people wishing to conduct business in the U.S. can travel without obtaining visas, unless they are otherwise inadmissible.

A. You may enter the U.S. without a visa

B. You do not require any documents

Note: If you enter on the Visa Waiver Program, you cannot change your status to another nonimmigrant visa status, extend your stay beyond the 90 days, or adjust your status to permanent residence.


II. Requirements for the Visa Waiver Program

To be eligible for entering the U.S. under the Visa Waiver Program, you must:

A. Intend to enter the U.S. for 90 days or less

B. Have a passport lawfully issued to you by a country eligible in the Visa Waiver Program

C. Be a national of the Visa Waiver Program country that issued your passport

Note: The following countries are currently in the program: Andorra, Austria, Australia, Belgium, Brunei, Denmark, Finland, France, Germany, Iceland, Ireland, Italy, Japan, Liechtenstein, Luxembourg, Monaco, the Netherlands, New Zealand, Norway, Portugal, San Marino, Singapore, Slovenia, Spain, Sweden, Switzerland, and the United Kingdom*.

For citizens with the unrestricted right of permanent abode in England, Scotland, Wales, Northern Ireland, the Channel Islands, and the Isle of Man.

D. Have been checked using an automated electronic database containing information about inadmissible aliens to the U.S.

E. Have a return trip ticket to any foreign destination other than a territory bordering on the U.S.

F. Present to the Immigration Inspector a completed and signed U.S. Citizenship and Immigration Services (USCIS) Form I-94W, Nonimmigrant Visa Waiver Arrival-Departure Document

G. Not pose a safety threat to the U.S.

H. Comply with the conditions of any previous admission under the Visa Waiver Program

I. Have no criminal convictions

J. Have no prior immigration violations

K. If arriving by air or sea, arrive on a carrier that signed an agreement (signatory carrier) guaranteeing to transport you out of the U.S. if you are found to be inadmissible or deportable

L. Convince the examining immigration officer that you are clearly and beyond a doubt entitled to be admitted and that you are not inadmissible

M. Waive any right to review or appeal an immigration officer's decision as to your admissibility, other than on the basis of an application for asylum or an application for withholding of removal under the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment

N. Waive any right to challenge your removal, other than based on an application for asylum or an application for withholding of removal under the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment
